Who you are contracting with

These terms are an agreement between you and BarberplanX, the operator of the BarberplanX platform ("we", "us"). Contact: hello@barberplanx.com.

Acceptance of these terms

By creating an account, booking an appointment, listing a barbershop or otherwise continuing to use the service you agree to these terms. If you do not agree, please stop using the service.

If you accept on behalf of a business you confirm you are authorised to bind that business. Individual users must be of legal age in their country.

The service

BarberplanX connects customers with independent barbershops. We are a booking platform; the haircut service itself is provided by the barbershop, not by BarberplanX.

We grant you a limited, non-exclusive, non-transferable right to use the app for its intended purpose.

Bookings and cancellation

A booking is a reservation with the barbershop. Please arrive on time and cancel in the app if you cannot make it.

Repeated no-shows may lead to account restrictions.

Customer payment

Customers pay the barbershop directly in cash at the shop. Prices shown in the app are set by the barbershop and are indicative until confirmed at the shop.

Barbershop membership and billing

Barbershops pay a monthly membership of 500 MAD (billed as €46 per month for card payments) to list on the platform. The membership renews monthly until cancelled and can be cancelled at any time, effective at the end of the paid period.

Barbershops in Tangier may pay in cash, collected by our team. Barbershops elsewhere pay by card through our online checkout.

For card payments, billing, taxes, invoices, cancellation and refunds are handled by Paddle under the Paddle Buyer Terms: https://www.paddle.com/legal/checkout-buyer-terms.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Acceptable use

You must not misuse the service. This includes unlawful use, fraud or spam, infringing anyone's intellectual property, uploading content you have no rights to, and interfering with security (malware, probing, scraping, circumventing technical limits).

You are responsible for keeping your credentials confidential and for activity under your account, and for providing accurate information.

Reviews and content

Only customers with a completed appointment can review that appointment, once.

Reviews must be honest and respectful. Hateful, abusive, discriminatory, sexual or spam content is not allowed and will be removed. Users can report content and abusive accounts can be blocked or removed.

You keep ownership of the content you upload and grant us a limited licence to host and display it solely to run the service. Rights holders can request a takedown via our contact address.

Intellectual property

BarberplanX owns the platform and all intellectual property in it, including the software, design, documentation, the BarberplanX name and logo. Nothing in these terms transfers that ownership to you. You may not copy, resell, redistribute or reverse engineer the service.

Service level and warranties

The service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, timely, secure or error-free operation, and availability may be affected by maintenance, third-party providers or events beyond our control.

To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

Suspension and termination

We may suspend or terminate access, in whole or in part, in case of material breach of these terms, non-payment of the membership, suspected fraud or a security risk, or repeated or serious policy violations. Where reasonable we give notice and an opportunity to fix the problem.

You may stop using the service and delete your account at any time. On termination, access ends and data is handled as described in our Privacy Policy.

Liability

BarberplanX is not liable for the quality of the service delivered by a barbershop, but we do act on reports of misuse.

We are not liable for indirect or consequential loss, including lost profits, lost data or loss of goodwill. Our total liability is limited to the fees you paid us in the 12 months before the claim. Nothing limits liability for fraud, death or personal injury where the law does not allow it.

You indemnify us against claims arising from your content, your unlawful use of the service or your breach of these terms.

Law and disputes

These terms are governed by Moroccan law and disputes are subject to the competent courts of Tangier, Morocco, unless mandatory local law provides otherwise.

We may update these terms; material changes will be announced in the app. You may not assign these terms without our consent; we may assign them as part of a merger or acquisition.
